"Pro" constuction, design changes without mfg perm

Post by Wayne G. O'Shea » Sat Feb 18, 2012 9:00 am

Sorry I opened a can of worms guys!

Just trying to keep the "community" informed and up to date on
"interpretation" of the regs in Canada. Maybe I should throw my computer
away and go back to hiding in the hanger.... or better yet off burning holes
in the sky and doing my part to deplete the fossil fuel supply! (my wife
would appreciate the house getting finished as well - considering we've been
in it for almost 8 years) Also to be quite honest TC hates nothing more
than an open discussion and prefers to do otherwise like any other
government operation. That's why I thought it imparative that I participate
in this issue, when the opportunity presented itself as a representative of
the RAA... as well as a known "professional" that has advertised the fact
since 1994. There's not much that I haven't seen go on (or have knowledge of
going on) in the last 10++ years and TC knows it, that's why I was invited.

Didn't mean to get anyone upset or to be construed that they are doing
anything outside the regulations. This is my last entry on this subject
until Ottawa responds to what was put together on Monday during our
gathering in Toronto.

Since Bill Hayes popped his head in here (with email address to tell where
he's from) the facility I mentioned is doing nothing "wrong" in Lindsay per
the current regs, or any before hand, as the owner/builder is TOTALLY
responsible for the construction of their airplane..nobody else. It just
appears that this is where the "issue" first came about and unfortunately
their web page description of what they do gives the wrong impression and
this is what opened TC's eyes (really wide) in the first place to get this
nonsense going (and the talk of lawn ornaments). The other problem is it
there doesn't seem to be any proof that the "builder" (check writer) is
really overseeing the construction or assembly (as per the regs). If Bill
and the crew change their "aircraft production" home page to better describe
the owners role in overseeing the process (and make sure the owner/"builder
of record" really does so), instead of stating that they take care of
everything for the owner, it would be almost "home free" from there.
Statements like.. "When we assume the responsibility for the completion",
"All aspects are taken care of for you" and "production facility" don't
appear to sit very well with the powers to be. (I'm trying to help you
Bill...nothing else!) If they can get rid of these statements on their web
page, so that the next time TC goes to point them out to someone they find a
page showing the "builders" role in the process instead....it would do a LOT
to calm the seas!

Cheers,
Wayne

I sure can learn a lot just reading this forum. I am sure this is what
TC wants, some open discussion. I would hope some of this does funnel
down to them. This is what policies are made of. Years ago builders met
a couple of times a year over a weekend and talked changing regs. Now
in the comfort of our homes 24/7 366 days (this year) discuss the
future of aviation. TC ,FAA , or JAA all want to give us what the
masses want, within reason.

I figured I had to say something, since I haven't posted for a couple
of weeks.
