instruction during flyoff in US

Unfortunately the FAA is not as enlightened in this area as it seems Transport Canada is. It is not generally permitted to have anyone for any reason, except the pilot, in an experimental during phase one flyoff. The lone exception is "required crew". If you try an end run with this one you may end up with permanent "required crew" in your operating limitations. I have been told there may have been FSDOs that allowed an instructor during phase one but absolutely not mine. Be careful with breaking the regs as your insurance would most likely be void.

My view is that a qualified instructor would add to safety (after initial solo flight) by a low time,rusty, or task loaded pilot but then, who says the FAA actions have to make sense?
