intake-exhaust pipe confilct

hi all

on my engine there is a potential conflict between one intake tube and one
exhaust pipe, with exhaust not tight there appears to be maybe 5mm clear and
of course when it torque down the exhaust pipes is suspect the exhaust pie
will contact the intake tube, what should i do, this cant be left as far as
i am concerned, any suggestions ??
