Ted you are correct w.r.t. Who can do the maintenance ... Provided the aircraft is certified. The issue is getting that homebuilt cert to begin with. Sorry all about the blackberry trailers ... I'm on the road. Cheers, Bob 612e

Keep in mind that plenty of people purchase flying experimental planes after
a builder decides to sell. In the case of someone purchasing a partially
completed kit (whether it's 53% complete or 99% complete), the worst case it
would be no different than if someone purchased a completed, flying plane.
They would be able to do their maintenance per the EAA article Mike quoted
and have to have an A&P do the annual condition inspections.

aircraft is completed ... By someone other then YOU.. As a EAA Tech Advisor
myself, I can assure you one or more TA logged visits, although being a good
indicator on the quality of construction to date, has no bearing on the 51

The airplane was inspected by an EAA inspector before the wings and tail
were closed up. Will this help the cause or am i better off staying away
from
this one. At What point in the build can i step in an it not be a problem

Robert,
So the straight scoop is that i will have certification problems if i purchase a
kit more than 51% is that correct. So my statement would be true that a
project more than 51 % "by the book" would be worthless. I hear what is
being said about being creative with receipts but i'm also not a gabbler with
this much money The owner has the wings, tail and a the structure of the
fuse done. Wings fitted and door pannels started. He is tellling me that
engine,interior,finish,and panel will allow certification (I think he is full of
something). I have an EAA TA that I'm trying to hire to come out and look at
the project.

So the straight scoop is that i will have certification problems if i purchase a
kit more than 51% is that correct. So my statement would be true that a
project more than 51 % "by the book" would be worthless. I hear what is
being said about being creative with receipts but i'm also not a gabbler with
this much money The owner has the wings, tail and a the structure of the
fuse done. Wings fitted and door pannels started. He is tellling me that
engine,interior,finish,and panel will allow certification (I think he is full of
something). I have an EAA TA that I'm trying to hire to come out and look at
the project.

Hahaha good one !! Not exactly .. but close. At least at this time, EAA is not in the aircraft certification business ... as is the FAA. And FAA inspectors (and DARs) get paid for what the do. EAA TAs are volenteer only, and are not suposed to hire out (or accept any form of compensation) relating to their TA services. If your TA is also an AP (many are) .. Then he can wear his (or her) AP hat and get paid. Not saying you can't or shouldn't pay him .... is so, you might not want to also say he's looking at the project wearing his TA hat.. Bob 612e

To follow up .. Did you read my "I was wrong" ... You can cert an "almost done" kit built as amature homebuilt. Just list all "builders" on the paperwork. Cheers, Bob 612e

Having seen what is already complete on fast build kits I wouldn't be so
quick to conclude that what you have left to do would not meet the 51% rule.
The unfortunate thing is that it varies widely from one FAA inspector to the
next. The determination of how much you completed is pretty subjective.
One guy might say 40% and another guy might say 60%. The FAA guys are far
from even handed across the board. When I talked to local builders and IAs
in my area about my final inspection I heard a lot of "thank goodness you
got so and so instead of that other guy" for my inspection.

If you are interested in this particular project, and the repairman's
certificate is something you want, talk to the local FSDO and see if you
have a shot at 51%. If you don't care about being able to do the annual
yourself and you like the project, go for it. You can still do all the
maintenance you want. Just have to find an A&P to do the annual. Get the
right paperwork together with all the builder's names, including yours, and
you will get it certified unless the workmanship is truly unairworthy.
